Wenn Ihre Wunschdomain schon von jemand anderem registriert wurde haben Sie, um mal mit der DENIC zu sprechen "[...] grundsätzlich [...] einfach Pech". Die DENIC vergibt Domains (wie übrigens alle Domainregistrierungsstellen) nach dem Motto "Wer zuerst kommt mahlt zuerst", oder neudeutsch "First come, first served". Wenn Sie nun der Meinung sind, dass Sie an einer Domain ein "besseres" Recht haben, als der gegenwärtige Inhaber (z.B. durch Markenrechte), können Sie bei der DENIC einen Dispute-Eintrag beantragen und versuchen, den aktuellen Inhaber zu einer Übergabe (notfalls auch mit rechtlichen Mitteln) zu bewegen.
Ein Dispute-Eintrag bewirkt, dass der jetzige Inhaber die Domain nicht auf Dritte übertragen (verkaufen) kann, und Sie bei Freigabe der Domain als bevorzugter Neuinhaber behandelt werden, d.h. die Domain an Sie weitergegeben wird. Ein solcher Dispute-Eintrag kann nur von der DENIC selbst vorgenommen, und auch wieder gelöscht werden. Sie müssen der DENIC allerdings glaubhaft nachweisen (z.B. durch geeignete Dokumente), dass Sie die "besseren" Rechte an der Domain haben.
